Participation Waiver and Release of Liability

For Pickleball, Tennis, Basketball, Swimming, Use of the Gym, Yoga and any other activity not listed here

Effective Date: June 01, 2024

1. Registering and Taking Part in Our Programs

In registering and taking part in any of our programs, I, do so with the understanding that participation is at my own risk; specifically in regard to taking part in a class or program outside with all the inherent risks associated with being outdoors, including but not limited to surface elevation irregularities, insects, as well as the potential transference of the COVID19 virus. I acknowledge that the Governor of Delaware declared a State of Emergency and the Town of Bethany Beach did as well related to the COVID 19- Pandemic. The World Health Organization has declared COVID-19 a global health pandemic and the President of the United States declared the COVID-19 pandemic a national emergency. I acknowledge and understand the dangers of being in public and participating in group programs during the COVID 19- pandemic.

2. Indemnify and Hold Harmless

Furthermore, I, my agents, successors, personal representatives, assigns, heirs and next of kin, hereby expressly agree to indemnify and hold the Community of Bethany West, its officials, officers, agents, employees, and representatives harmless from, for and against, any and all liabilities, claims, suits, demands, judgments, causes of action of any kind (at law or at equity) losses, damages, costs or charges (including attorneysï¿½ fees), related directly or indirectly to my participation in the above program, including any and all injuries I may sustain while participating in the program and possible COVID 19 exposure while participating in the program.

3. I release, waive, discharge and covenant not to sue

I release, waive, discharge and covenant not to sue the Bethany West Recreation Association, CourtTime Pro, Bethany West, the Bethany West Recreation Association or the Town of Bethany Beach or any of their departments, or its officials, officers, agents, employees and representatives, all of whom for the purpose of this release are referred to as Releasees, from all liability to myself and my agents, successors, personal representatives, assigns, heirs and next of kin, for any and all loss or damage on account of injury to my person or property , whether caused by the negligence of the Releasees or otherwise, while participating in the program and on Bethany West or the Town of Beach property. I agree that the foregoing Release is intended to be as broad and inclusive as is permitted by the laws of the State of Delaware and that if any portion of it is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

4. Risky Nature of Physical Activity

Please Note: Due to the strenuous nature of some activities, participant is urged to consult his or her physician concerning fitness to participate. All activities present certain inherent risks and hazards which the participant is urged to consider and which the participant assumes.

5. Agree to be Photographed

Participants may at be photographed for publicity purposes while participating in said program and agree to their image and likeness being used by CourtTimePro, Bethany West Recreation Association or the Town of Bethany Beach.

6. You Agree

By clicking the link on the registration form you express your understanding and intent to enter into this Participation Waiver and Release of Liability willingly and voluntarily.
